LAHORE: All the Bar Associations of Pakistan have advised Mutahida Majlis-e-Amal (MMA), not to approach the Supreme Court on “oath-taking” issue, because they think that the SC will support Legal Framework Order (LFO).
Sources in judiciary told NNI that in a meeting of the representatives of the Bar Associations and members of MMA, held at Islamabad, the lawyers urged the MMA leadership not to take oath under the LFO. On a question from Qazi Hussain and other MMA leaders that what would be the possible alternative, the constitutional experts sought time for finding a viable advice on the issue.
The representatives of the Bar said that Gen Musharraf had increased the term of superior judiciary judges by three years to avoid any possible 'judicial impeachment' in future.
The meeting was attended by Vice President of the Sarhad Bar Council (SBC), Shaukat Ali Khan; Members Pakistan Bar Council (PBC), Hafiz Abdul Rehman Ansari; constitutional experts Habib ul Wahab ul Khairi; Chaudhary Ikram and President Islamabad Bar Association (IBA), Raja Ishtiaq.
The Bar representatives presented a joint resolution of the Pakistan Bar Council (PBC), Supreme Court Bar Association (SCBA), all the four Bar Councils of the provinces and Lahore High Court Bar Association (LHCBA) as a reminder to the MMA leadership. Through this unanimously accepted declaration, almost all the political parties had pledged not to support the so-called 'constitutional package' of Musharraf regime introduced to amend the 1973 Constitution in a meeting held at the LHCBA building in August.
The MMA leadership was of the view that they did not want to endorse Musharraf's constitutional package, yet they were in a fix over the constitutional situation.
Regarding statements of the federal law minister about the restoration of 1973 (amended) Constitution, they said the Supreme Court (SC) had allowed the present regime till October 12, 2002. After this the existing set-up will be not more, therefore, such statements have no status.
