SC declares emergency, PCO valid
ISLAMABAD:
Seven-member larger Bench of the Supreme Court has declared the enforcement
of emergency in the country and the issuance of Provisional Constitutional
Order (PCO) correct and Judges not taking oath under PCO deposed.
SC larger Bench headed by the PCO Chief
Justice, Abdul Hameed Dogar announced this verdict today.
Tikka Mohammad Iqbal and Watan Party’s
Barrister Zafrullah had challenged the November 3 enforcement of emergency
in the country and the issuance of PCO.
The Court in its verdict said that the
emanating situation in the country prior to November 3 was such that
the emergency could have been enforced. The Court said that those superior
courts judges not taking oath under PCO ceased to hold their posts and
the cases taken up for hearing by these Judges were also not maintainable.
SC in this verdict declared justified
November 3 enforcement of emergency and all the steps taken by the President
General Pervez Musharraf on this occasion.
