I was detained on refusal to quit: CJ Ifkikhar
ISLAMABAD:
In his constitutional petition to the Supreme Court, Chief Justice
Iftikhar Muhammad Chaudhry has contended that he was detained at the
president's camp office after he refused to quit his office, reports
a British TV. The federal government termed the accusation as 'baseless'.
The 40-page petition has questioned the forced leave,
composition of the Supreme Judicial Council and its competence to
hear a reference against the chief justice.
It also questions the impartiality of some SJC members,
contending that the Article 9 of the constitution guarantees judicial
proceeding by a neutral forum. The petition says that appointment
of the acting chief justice in the presence of the chief justice is
unconstitutional, and that the Supreme Court does not exist without
the chief justice.
The petition maintains that the doctrine of necessity
does not apply in CJ's case.
